TERMS OF SERVICE - Sunday Drop — Effective from 2026

OVERVIEW
Welcome to SUNDAY DROP! Throughout this site, "we", "us" and "our" refer to SUNDAY DROP. By visiting or purchasing from our store, you agree to be bound by these Terms of Service and our Privacy Policy.

If you do notagree, please do not use our Services.

SUNDAY DROP is powered by Shopify, which provides the e-commerce platform that allows us to sell our products and services to you. Any sales and purchases are made directly with SUNDAY DROP, Shopify is not responsible for any aspect of transactions between you and us.

SECTION 1 - ACCESS AND USE
By using our Services, you confirm that you are at least the age of majority in your state or territory, or that you have given consent for minor dependents to use the site on your device. You may not use our Services for any unlawful or unauthorised purpose, transmit malicious code, or violate any applicable laws. A breach of these Terms may result in immediate termination of your access.

SECTION 2 - PRODUCTS AND ORDERS
We have made every effort to accurately represent our products, including colours and images. However, we cannot guarantee that your device's display will be fully accurate, and product descriptions are subject to change without notice.
When you place an order, you are making an offer to purchase. SUNDAY DROP reserves the right to accept or decline any order at its discretion. Your order is not confirmed until we accept it and process payment. We may be unable to accommodate cancellation requests after an order is accepted.
We reserve the right to limit quantities, discontinue products, or restrict sales to any person or region at any time.

SECTION 3 - PRICES AND BILLING
Prices are subject to change without notice. The price charged will be the price in effect at the time of your order, as set out in your confirmation email. Posted prices do not include taxes, shipping or handling unless expressly stated.
You agree to provide accurate and complete billing and payment information and to promptly update your details as needed. You represent that you are authorised to use the payment method provided.

SECTION 4 - SHIPPING AND DELIVERY
We currently ship to Australia and New Zealand only. We aim to process orders are processed within 2 business days. Once dispatched, you will receive a confirmation email with tracking details. We ship via Australia Post. All delivery timeframes are estimates only and are not guaranteed. We are not responsiblefor delays caused by Australia Post or events outside our control. Risk of loss passes to you once your order is transferred to the carrier.

SECTION 5 - RETURNS
Your purchases are subject to return or exchange solely in accordance with our Refund Policy, which is available on our website.

SECTION 6 - INTELLECTUAL PROPERTY
All content on our Services, including trademarks, text, images, graphics and design, is owned by SUNDAY DROP or its licensors and is protected by Australian and international intellectual property laws. You may not reproduce, distribute or use any content without our prior written consent.

SECTION 7 - THIRD-PARTY LINKS AND TOOLS
Our Services may contain links to third-party websites and optional third-party tools. We do not monitor or control these and provide access to them "as is" without any warranties or endorsement. Any use of third-party tools or websites is at your own risk. Complaints regarding third-party products or services should be directed to the relevant
third party.

Any feedback, ideas or suggestions you submit to us may be used by SUNDAY DROP for any purpose without compensation or obligation to you. You are solely responsible for the accuracy of any feedback you provide, and it must not violate any third-party rights.

SECTION 9 - PROHIBITED USES
You may not use our Services: (a) for any unlawful purpose; (b) to violate any applicable laws or regulations; (c) to infringe our intellectual property or that of others; (d) to harass or harm any person; (e) to transmit false or misleading information; (f) to upload viruses or malicious code; (g) to collect others' personal information; (h) to use automated
tools, bots or AI agents to access the Services without permission; or (i) to interfere with or circumvent the security of our Services. We reserve the right to terminate your access for any violation.

SECTION 10 - AGENTS AND AUTOMATED ACCESS
Any software or service acting autonomously on a user's behalf (an "Agent") must identify itself clearly in all requests, must not mimic human behaviour or bypass security measures, and must cease access if we request it. We may restrict Agent access at any time by technical or other means.

SECTION 11 - DISCLAIMER OF WARRANTIES
To the extent permitted by law, our Services and products are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement. We do not guarantee that the Services will be uninterrupted, timely, secure or error-free.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot be excluded by agreement. Where liability can be limited, it is limited to replacing or repairing goods, or resupplying services, at our option.

SECTION 12 - LIMITATION OF LIABILITY
To the fullest extent permitted by law, SUNDAY DROP and its directors, employees, affiliates and service providers shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Services or any products purchased through them. Our total liability for any claim shall not exceed the amount you paid for the product or service giving rise to the claim.
Nothing in this section limits any rights you have under the Australian Consumer Law.

SECTION 13 - AUSTRALIAN CONSUMER LAW
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. Nothing in these Terms is intended to exclude, restrict or modify any rights you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

SECTION 14 - INDEMNIFICATIO

You agree to indemnify and hold harmless SUNDAY DROP, Shopify, and our affiliates, officers, employees andservice providers from any claims, losses or liabilities arising from your breach of these Terms, your violation of any law, or your use of the Services.

SECTION 15 - GENERAL
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in fullforce.
Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our
rights without notice.
Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement
between you and SUNDAY DROP regarding your use of the Services.

SECTION 16 - GOVERNING LAW
These Terms are governed by the laws of Victoria, Australia. You and SUNDAY DROP submit to the exclusive jurisdiction of the courts of Victoria, and any courts entitled to hear appeals from those courts.

SECTION 17 - CHANGES TO TERMS
We may update these Terms at any time by posting changes to this page. It is your responsibility to check periodically for updates. Your continued use of the Services after any changes constitutes acceptance of the updated Terms.
